A revised chapter 13 plan form takes effect today for any plan filed, amended or modified in this district. . The Court's website for the new plan is linked HERE.

The Trustee's overview of significant changes compared to the prior plan can be found HERE. A new Trustee Plan Tips document document will be updated a month or so from now to address any common concerns with the new plan form. The current Tips document may still be relevant in many areas but is no longer correct in the secured area at least.

Trustee Rebecca Garcia and Trustee Mark Harring presented to the Western District Bankrupty Bar today on chapter 12 issues. Click HERE for a link to their materials.

At the end of that presentation there was discussion concerning the Wisconsin Homeowner Assistance Fund (HAF). HERE is a link to HAF materials.

There was also discussion on the USDOJ guidance regarding student loans in bankruptcy. See the below news entry for that.

Lastly there was a brief discussion of a Texas case involving student loans and separate classification of unsecured debt. The case cited was :In re Victoria Florita Durand-Day, 2022 WL, 14938726 (Bankr. N.D. Tex, October 26, 2022)

Nov 17, 2022 The US Deparment of Justice issued new guidance regarding student loans and bankruptcy. This was developed along with the US Department of Education. One key element is the definition of hardship. This may serve to alter current case law that uses the "Brunner test" when seeking a discharge of student loans. HERE is a link to the new DOJ guidance.
Sep 28,2022 The House Judiciary Subcommitee on Antitrust, Commercial, and Administrative Law plans to hold a hearing tomorrow, September 29th on potential bankruptcy reform. It is not clear at this time the entirity of what will be proposed. Some may involve student loans. Click HERE to see the NACTT press release concerning student loans.
June 6, 2022 The trustee's office has physically moved to a new location as shown in the contact us page of this web site. There were no changes to payment, email, phone, 341 meeting instructions or other related items.
Apr 1, 2022 Revised Dollar Amounts in Official Forms 106C, 107, 122A-2, 122C-2, 201, 207, 410, Director's Forms 2000 and 2830, and certain instructions, effective April 1, 2022. Of note for chapter 13, effective June 21st, is that allowed debt is increased to $2,750,000. There is also the elimination of a distinction between whether the debt is secured or unsecured. Now, total debt cannot exceed the $2,750,000. More information can be found HERE

The Judicial Conference has published rule and fee changes expected to take effect December 1st, 2020. Rules2002, 2004, 8012, 8013, 8015, and 8021.are expected to change. Of note, it is expected that Rule 2002 will limit noticing to creditors who do not file claims. More information can be found HERE . Fee changes are largely inflationary based. May 29, 2020 The trustee has been approved by the Office of the United States Trustees as a Personal Financial Managment Provider using the Trustee's Education Network (TEN). If a debtor is eligible to receive a disharge in chapter 13, they must complete a financial management course. As a reward for completion, the trusee underwrites the fee for this course. The President signed new bankruptcy legislation today. Three of the acts are effective immediately.  One increases the debt limit on chapter 12 to ten million.  The other two are military service related and effect the means test calculation or the definition of current monthly income (CMI).  The fourth act creates a new small business bankruptcy subsection within chapter 11.  Click here for more information.

When attending 341 meetings in Madison be aware the existing parking lot is being torm up and being replaced by a hotel. Eventually there may be underground parking available to replace the surface spots currently available. Most nearby lots will require a 10 minute walk. The federal government’s funding shutdown does not affect our office, your bankruptcy plan requirements, scheduled hearings, and 341 meetings.   The Trustee is not a federal employee and is not funded by the federal government.  We will continue to operate regardless of what happens at the federal level.  This means that all plan payments, disbursements, and oversight performed by this office will continue largely unaltered.  Debtors should continue to make plan payments.  Creditors should continue to expect payments as directed by the plan.   Attorneys and Creditors should continue to file using the court’s CM/ECF system to file.  We will continue to respond to emails, answer the phone and otherwise operate normally.

The court may receive emergency funding.  For now, you should continue to appear for scheduled hearings and expect normal response from the courts.  We will post an update if this changes. 

The United States Trustee (UST) will likely be operating at a reduced level.  Most of their staff will be on furlough and their offices will be largely shut down.  341 Meetings held at UST offices or other locations will continue to be held.  Please plan to appear for these in the normal fashion.

If you are a federal employee, you may want to talk to your attorney about a temporary plan suspension.

Current case information is available at NDC.ORG You are encouraged to sign up with them to view your cases. We have been sending case information to the NDC since March of 2014 and have found them to be a reliable alternative to hosting case information directly. It is not clear at this time if we will directly host case information in the future. Debtors and creditors can register directly on the NDC site. Debtor attorneys need to Contact Us to register.
Dec 17, 2018 We have recently undergone a software change. Unfortunately this caused a delay in mailing November 30th disbursements as we wanted to ensure their accuracy. Oct 19, 2018 Modifications to the IRS proof of claim form were announced. These changes are retroactive to October 1st, 2018. For the most part, they better clarify the reason for the claim.
Aug 17, 2018 Miscellaneous updates to the Trustee Plan Tips document have been made. This document is meant to assist you in using the local plan form. As part of this, the Trustee has decided that if a secured claim is filed for less than the amount set in the plan, the lower claim amount will be paid. With that exception, other terms set for that creditor in the plan will be followed. This change applies retroactively to all open cases after December 1, 2017

Changes have been made to the trustee’s summary of claims report mailed out near a case’s bar date.  The changes are designed to better show new treatment to non-governmental secured creditors resulting from the December 1st, 2017 plan form adoption within this district.

Effective February 1st 2018, the Trustee has changed his position on treatment of post-petition fee notices (PPFN).  Prior to this date, the notices were treated as a supplemental claim.  Absent plan language to the contrary, the standardized plan recently adopted by this district no longer permits this treatment.  Henceforth the PPFN’s will be treated as what they are; a notice.  The Trustee recognizes that these notices indicate an underlying payment needs to occur but leaves it to debtor and creditor counsel to implement the means.

Nov 6, 2017 District wide forms for the new Chapter 13 Plan, a request to Modify a Confirmed Ch 13 plan, and a Request to Amend an Unconfirmed Ch 13 Plan have been published on the court website. These are effective Dec 1, 2017 and should be used on all cases filed after that date and as much as practicable on those filed before that date.

On 10-26-2017 the President signed into law an Act amending 11 USC by adding section 1232. This new section deals with pre and post-petition unsecured debts resulting from the sale, transfer, exchange etc., of property used in the debtor's farming operation. Most importantly, this clarifies treatment post BAPCPA and gives you a tool for dealing with capital gains taxes that may arise. Click here for a copy of the Act (see pg 9)

There are pending rule changes taking effect December 1st 2017. Most importantly this affects filing of proof of claims and the adoption of a standardized chapter 13 form plan. The Standing Trustee and Staff Attorney Griffith will be speaking at the WDBB luncheon Wednesday November 8th and at the State Bar Annual Bankruptcy update on November 15 and 16 on these topics. Bankruptcy attorneys are urged to attend one of these sessions as these rule changes will directly impact your Chapter 12 and 13 practice.

The Judicial Conference Advisory Committees on Appellate, Bankruptcy, Criminal and Evidence Rules have proposed amendments to Bankruptcy Rules 2002, 4001, 6007, 9036, 9037, and Official Form 410, and have asked that they be circulated to the bench, bar, and public for comment.  The public comment period ends February 15, 2018.

Judge Robert D. Martin retires on of this date. Judge Martin has been a bankruptcy judge in the Western District of Wisconsin since 1978, and was its chief judge until 2012. Chief Judge Furay will assume Martin's seat in Madison and continue to hear cases throughout the district. It is expect a new judge who will hear cases in both Eastern and Western Wisconsin will be named soon. That judge is expected to primarily hear cases filed in the northern part of this district.

We would like to thank Judge Martin for his many years of service to the bankruptcy community and wish him well in the future.

Jul 1, 2016 The Judicial Conference Advisory Committee on Bankruptcy Rules has proposed amendments to Bankruptcy Rule 3015 and adoption of new Rule 3015.1 One of the more significant outcomes affecting this district will be the implementation of a standardized Chapter 13 Plan. Paying plan payments in cash is now possible thru the TFSBilPay system. TFS has partnered with MoneyGram to allow this feature. There is a short intitial set up and cost for this option. Click here for a link for more information. Paying your plan thru employer wage deductions is still the cheapest and most effecttive way to complete your plan. This new option simply allows initial payments, catch up payments or self employed people another option.

May 1, 2016 The minimum trustee fee rate used when calculating plan feasiblity and payment to creditors is 7%. The actual rate fluctuates at least anually. See Attorney FAQ page for more information.
May 1, 2016 The IRS has revised national and local standards used in the means test. Most of their expense standards went down. Cases filed after May 1st will have to use these new numbers in the means test calculation. Please update your software or calculations. Dec 16, 2014 Reminder that the comment period for the proposed bankruptcy rule changes that were published this May closes February 17, 2015 at 11:59 p.m. Click here for the preliminary draft of those rules and how to comment on them. Notably there is a proposed national chapter 13 plan, changes in filling of claims and bar dates, noticing changes, changes in determining secured and priority amounts, and changes in objections. We urge you to review these changes and comment on them if you see fit. They will significantly affect local practice in the upcoming years.
Dec 1, 2014 Bankruptcy Form 22C (or B22C) will be replaced by two separate forms, Form 22C-1 and Form 22C-2. The new forms do not involve major changes—anyone familiar with the current form will recognize most of what appears on the new versions—but the forms do have a new look and involve some material changes. The Executive Office of the United States Trustee (EOUST) has revised their position concerning the timing of the percentage fees collected by Standing Chapter 12 and 13 Trustees.  This new policy requires that Standing Trustees nationwide take and account for their percentage fee at the time of the receipt pursuant to 28 U.S.C. §586(e)(2). Previously Standing Trustees had collected the fee at the time of disbursement.  This change is simply a timing change and has no effect on the total fees paid.

TFS Bill Pay is now available for Chapter 13 debtors currently paying by money order or cashier’s check.  Click here for TFS website  This system allows online automated payments to our office.  Debtors will need to allow five days for processing, so they should have the payments come out early enough to arrive in our office by the Plan payment due date.  The debtor will need their case number, district and payment information to set up the payments.   Recurring payments can be set up.  There is a small fee associated with the service but the fee may be less than that required to purchase a money order or cashier’s check and should be much more convenient for debtors.  Please contact TFS directly 888-PAY-CH13 with any questions.

Nov 4, 2013 IRS announces new living standards used when computing the means test (form 22C). Per United States Trustee, the new standards apply to cases filed on or after November 15, 2013. For Wisconsin, the new median familiy income will be $43,958 for a family size of one. For 2, 3, or 4 people the amounts are $57,903, $67,808, $80,198 respectively. Above 4 add $8,100 per each individual in excess of 4.

April 1, 2013 All vehicle titles and evidence of mortgage liens must be submitted prior to the 341 meeting. These documents must be provided as separate PDFs with proper title (i.e., “Case #”-“Mortgage Info” or “Vehicle Title”) and emailed to our office at info@ch13wdw.org . The Trustee’s office will not accept any documents via paper or fax. Trustee Harring will delay recommending confirmation if the required documents are not filed.

Feb 1, 2013 Effective February, 1st 2013, Mr. Mark Harring will become the Standing Trustee in this district. Cases currently administered by Standing Trustee Sheree Dandurand will transfer to him at that time. Mr. Harring has over twenty five years of bankruptcy experience and is knowledgeable in all facets of Standing Trustee operations. There are no significant changes in policy, practice or personnel anticipated as a result of this change.
Jan 1, 2013 Judge Catherine J Furay appointed to replace Judge Utschig for cases in the northern part of this district. Judge Furay will preside in Eau Claire. Please welcome Judge Furay to the bench.

NOTICE: In accordance with a change in the United States Trustee program s policy under 28 U.S.C. Section 586, a percentage fee will be earned by the Standing Chapter 13 Trustee on receipts in cases that dismiss or convert pre-confirmation.  The percentage fee will be at the same rate as that established by the United States Trustee s office for disbursements made by the Standing Trustee on confirmed cases.  The Standing Trustee will  take the fee upon disbursement of all funds received in the case prior to dismissal or conversion. As is our practice, the funds, less the allowed percentage fee and any court costs, will be returned in a check payable to the debtor but mailed to the debtor s attorney.

This new policy is effective on October 1, 2012. The Standing Trustee will start taking these fees on funds that are disbursed on or after that date.
Please note that this new policy will affect all pending unconfirmed cases.

July 27, 2012 We are sad to anounce the passing of Standing Trustee William A. Chatterton. Mr.Chatterton served the bankruptcy comunity for over 46 years and will be missed. Sheree G. Dandurand the Assistant United States Trustee has been named the interim Standing Trustee. All cases managed by, and operations of, the Standing Trustee's office will continue largely unaltered. Aug 25, 2010 The minimum trustee fee for calculating plan feasiblity in relation to confirmation changed from 10% to 8%. See Attorney FAQ page. Actual rate varies and is usually lower but 8% provides a cushion in the event of an increase.
Feb 5, 2010 Most Apple and Android phones are sucessfully getting case information using their native browsers. If you are using the older verison of the Windows Phone, try using Opera as a browser. We have limited ability to support all platforms but if you have a mobile phone with a data plan that can run Opera 10 try it. Newer versions of mobile IE also work. Try your phone if you have data access.

Dec 3, 2009 Wisconsin exemptions change effective December 16, 2009. General effect will be to increase the amount allowed for most items. See this link to the Wisconsin State Legislature 2009 Act 80.
Dec 1, 2009 Rules change related to date requirements for filings, objections, service and other misc items change to being week based (7,14, 21 days) instead of a multiple of 5 (5,15,20 etc). Some examples; appeals are now 14 days, deadline for Schedules, Statement of Affairs, Plans, and Appellate Briefs now 14 days, standard notice now 21 days, relief from stay notice now 14 days. Rule 9006 contemplates that "days are days" meaning that you will count intermediate weekends and holidays, although if the deadline ends on a weekend or holiday, the deadline will still move to the next business day.
May 15, 2009 Sorting of the individuals shown on check stubs is now available. The individuals on the check stub can be sorted by Account number, Case number, or Last name. The default is last name. Please contact us if you would like your sort changed.
May 13, 2009 Free translation services are now available in over 140 languages at the 341 hearing. Other hearings may follow. Please contact us or the United States Trustee to set this up in advance of the hearing.

Aug 15, 2007 FAQ's added to Attorney and Creditor pages describing regional policy with respect to whether a plan or claim filing controls payment terms. Case Information screen that shows rececipts into a plan is now sorted in descending date order so that most recent information is at the top of the page.
July 24, 2007 Viewing and printing of "Statement of Account", and payment coupons added to debtor browse screen. Printing of receipt information added to receipt view screen. June 30. 2007 The trustee's office will be closed July 4th and 5th.
June 25, 2007 All cases filed after June 1st that have their 341 Hearing scheduled in Eau Claire, La Crosse, Rothschild (Wausau), or Superior will now be heard by Judge Utschig instead of Martin. This office will continue to be Trustee in all western district cases regardless of judge.
